The Settlement Process

The settlement-process chapter recognizes that the overwhelming majority of civil cases end in settlement, not trial. It walks students through the role of settlement in civil cases; the interplay between negotiation and pretrial motion practice; settlement within the litigation framework; alternative dispute methods including mediation; settlement documentation (agreements, implementing documents, multi-party cases, structured settlements, deferred and periodic payments); and the often-litigated topic of settlement enforcement (the need to enforce, motions and procedures, authority and finality). Especially useful in a negotiation or ADR course paired with a pretrial litigation seminar — it grounds settlement in the procedural reality that produces it.
